The Labour Court upheld a recommendation that The Legal Aid Board pay a worker €1,551 after she began an acting Grade II role and the offer was withdrawn following a seniority mistake. The decision was signed on 3 October 2008. The Court rejected the union's appeal, finding the Board correctly applied the seniority rules and higher-grade allowance rules. The Rights Commissioner had recommended the ex-gratia payment because the worker had started the role before the mistake was corrected. The recommendation also called for an up-to-date seniority list and withdrawal of any instruction to take work direction from a same-grade solicitor. The Board said it would formally confirm that a Solicitor Grade III should receive instructions from a more senior grade.
