The Labour Court upheld a Rights Commissioner’s recommendation in Superquinn’s annual-leave dispute after the worker’s appeal failed. The decision was signed on 22 September 2008. Represented by Mandate, the worker argued that Superquinn’s leave calculation after more than 26 weeks’ sick leave went against agreed practice. The Court found the policy unclear for longer absences, but said evidence showed a consistent practice of no leave accrual during that period. It recommended that Superquinn clarify the policy for future cases.
