The Labour Court overturned a Rights Commissioner’s recommendation and decided that a worker at Tara Mines Holdings should receive the Backfill rate from 22 January 2007. The decision was signed on 31 January 2008. The worker, represented by the Services Industrial Professional Technical Union, appealed an earlier finding that his claim was not well founded. He said redeployment left him at the bottom of the company’s pay structure, earning less than a colleague doing similar work. The company argued he did not qualify for higher miner rates because he lacked the necessary training.
