The Labour Court upheld a recommendation that Health Service Executive West permanently upgrade a psychiatric nurse from CNM1 to CNM2 and pay him €10,000 compensation. It dismissed the HSE’s appeal on 23 July 2008. The nurse worked in the Inisgile community-based unit. The union said he reported to an Assistant Director of Nursing for at least half his time and performed work like a CNM2 on the opposite shift. The HSE argued that the rules for upgrades did not allow it and that any upgrade had been intended for the nurse personally, not the post.
