The Labour Court disallowed Superquinn’s appeal and affirmed a recommendation to remove a verbal warning and pay €2,000 compensation to a Night Shift Duty Manager at its Sundrive Road branch. The decision was dated 21 July 2008. Superquinn had alleged the worker was under the influence of alcohol at work. The worker, represented by Mandate, denied this and challenged the investigation. The Court found no credible evidence that he was under the influence at the material time. It held that the Rights Commissioner’s conclusions were reasonable and supported by the evidence, and that the compensation was warranted and appropriate.
