The Labour Court recommended €10,000 compensation for a worker after finding her dismissal from Bank of Scotland (Ireland) Limited procedurally unfair. The decision was dated 15 May 2008 and overturned the Rights Commissioner’s earlier recommendation that her claims were not well founded.

The worker disputed the Bank’s claims about her treatment of customers and said the €8,397 she received was money she had earned, not a goodwill settlement. The Bank said customer complaints and an investigation showed she was not suited to her customer-adviser role, and disputed her allegations about her manager.

The Court found the disciplinary procedures did not comply with the Bank’s own policy. It said the worker should have received two weeks’ sick pay and one month’s notice instead of one week. The €10,000 recommendation was in full and final settlement of the claims and took account of the payments already referred to.
