The Labour Court dismissed a worker’s appeal over incremental credit for acting as an inspector, affirming the Rights Commissioner’s recommendation that the claim was not well founded. The decision was signed on 6 May 2008. Dublin City Council appointed the worker as an inspector in its Mechanical, Heating Ventilation & Air Conditioning Section in April 2005, after he had acted in the role temporarily from October 2001. The Irish Municipal, Public and Civil Trade Union argued that he should have received incremental credit for that acting-up period. The council said it followed agreed pay procedures and treated the worker like other employees in similar circumstances. The Court noted the change in arrangements for acting-up roles from 2005 and endorsed the Rights Commissioner’s recommendation.
