Labour Court says Aircoach driver should have received benefit of doubt

In 2007, the Labour Court said an Aircoach driver should have received the benefit of the doubt over an allegation that he failed to issue a ticket to a passenger. The company had appealed a Rights Commissioner’s recommendation to reduce his final written warning to a written warning. The decision was signed on 3 December 2007. The Court considered the disciplinary sanction inappropriate, saying there was room for doubt about whether the source of the allegation could have been mistaken and that the union’s request to question that person was not entirely unreasonable. The warning had expired, so the Court expressed its opinion only. It said the union and company should discuss how public complaints are handled in disciplinary procedures.
