The Labour Court dismissed a worker’s appeal for promotion to Assistant Director of Nursing and upheld the Rights Commissioner’s recommendation that her Clinical Nurse Manager II grade was correct. The decision was signed on 19 July 2007. The Irish Nurses Organisation argued that the worker’s night duties supported the higher grade, with retrospective effect from November 2001. St Luke’s Hospital said its night operations did not require an Assistant Director of Nursing post. The Court found that her duties did not include the bed and general management responsibilities essential to that role. It also noted that the hospital did not meet the criteria for a Band 2 hospital.
