The Labour Court upheld a Rights Commissioner’s recommendation and dismissed a Superquinn worker’s appeal seeking compensation. The Court’s decision was signed on 10 July 2007. The sales assistant had been sent home after an assistant manager questioned his behaviour, although he returned with a doctor’s note saying he was fit for work. The union said the incident caused stress and embarrassment and sought compensation. Superquinn said the manager acted out of concern for the worker’s welfare, and that he lost no pay and faced no disciplinary action. The Rights Commissioner had recommended written confirmation that the note should have been accepted, that no disciplinary action be taken or recorded, and that any upset caused be regretted. The Court agreed with that recommendation; the appeal failed.
