The Labour Court varied a Rights Commissioner’s recommendation in a dispute between Marks & Spencer (Ireland) Ltd and a section manager over her performance review. In a decision dated 8 May 2007, it recommended that she accept her original 2004/2005 rating and that her line manager conduct further reviews for 2005/2006 and 2006/2007. The worker, represented by Mandate Trade Union, disputed an “Effective” rating in the “Be One Team” category. The union said a higher rating would have meant a €71.62 weekly pay increase, which it sought retrospectively. The company said she had declined a further review. The Court also recommended clearer performance criteria and less paperwork.
