The Labour Court rejected the Services Industrial Professional Technical Union’s appeal over a worker’s bid for promotion to Clinical Nurse Manager II at South Infirmary-Victoria University Hospital. Its decision was dated 9 January 2007. The union said the worker’s duties, responsibilities and experience supported the higher grade. The hospital argued that a recognised Theatre Course was essential for the post and that her duties were correctly graded at Clinical Nurse Manager I. The Court accepted the hospital’s right to require the qualification and did not accept that the worker’s duties warranted the higher grade. It upheld the Rights Commissioner’s recommendation against conceding the claim and rejected the appeal.
