The Labour Court upheld a recommendation placing an unnamed worker on point eight of a pay scale, with a salary of €27,240 from 1 January 2005. The decision was signed on 17 October 2006. The worker, a Medical Secretary, sought credit for earlier service as a Clerical Officer with Bus Eireann and was represented by IRISH MUNICIPAL, PUBLIC AND CIVIL TRADE UNION. Health Services Executive (North West) appealed, arguing that the national agreement did not cover that previous employer. The Court accepted that the agreement did not extend to Bus Eireann service, but found exceptional circumstances because the worker had understood before resigning and accepting the new position that her earlier service would count. It therefore upheld the Rights Commissioner's recommendation.
