The Labour Court affirmed a Rights Commissioner’s recommendation and disallowed a union claim over a worker’s sick pay. Its decision was dated 4 October 2006. The union argued that an indemnity form meant the worker’s wages should continue while she was absent on sick leave.
Management said the Health Service Executive North West had applied its sick-pay scheme, which provided six months on full pay, six months on half pay and pension-rate pay thereafter, subject to review. The Court found the scheme had been applied as agreed and consistently, and that the indemnity could not replace its terms. The union’s claim was disallowed.
