The Labour Court overturned a €4,000 Rights Commissioner recommendation after allowing Trinity College Dublin’s appeal. The Court’s decision was signed on 25 September 2006. The recommendation concerned a library assistant who challenged a proposed transfer after an unsuccessful application for Counter Supervisor. The Rights Commissioner had recommended an Executive 2 grade role, with evening duties eliminated or minimised, and a €4,000 lump sum. The worker, represented by Services Industrial Professional Technical Union, sought to remain in her current role and have the same opportunities as comparable staff. Trinity College argued that no promotion was merited and that the compensation recommendation should be overturned, while committing to minimise evening work in the identified post. The Court said an agreement applied to other staff, a promotion had been offered in another area, and the parties could not reach agreement following the Court’s invitation.
