Labour Court dismisses Cadbury worker’s appeal over delayed move to Rolls Operator

The Labour Court disallowed a worker’s appeal and affirmed the Rights Commissioner’s recommendation against his claim over a delayed move to Rolls Operator at Cadbury (Ireland) Limited. The decision was dated 11 August 2006. The worker said Cadbury could have used a relief stores person to let him take the position earlier. The company said the person due to replace him in the stores was on sick leave, and argued that he should have pursued the matter through the agreed grievance procedure. The Rights Commissioner found that the worker suffered no financial loss, that the company followed agreed procedures and that the claim was not justified. The Labour Court found no basis to interfere with that recommendation and dismissed the appeal. The company declined to attend the hearing but provided a written submission, which the Court considered.
