The Labour Court dismissed a worker’s appeal and upheld a Rights Commissioner’s recommendation against continuous payment of a special rate for operating a tar sprayer at Cavan Co Council. The decision was signed on 3 August 2006. The worker sought the rate for more of the year, saying he operated the machine for an extended period. The Council said he received an allowance while operating it under the 1993 agreement and was appropriately graded. The Rights Commissioner found that the arrangements complied with the agreement and that there was no justification for continuous payment of the rate. The Labour Court agreed with the findings and dismissed the appeal.
