The Labour Court disallowed Chubb Ireland Group's appeal and affirmed a recommendation that it pay an anonymous worker €6,000 compensation for lost earnings. The worker had already received a €2,500 goodwill payment.
The company argued that the earlier payment settled the claim. The Court found that the agreement did not say the €2,500 was in full and final settlement, and that the worker reasonably expected to seek compensation if his hours were not restored. The worker was represented by Services Industrial Professional Technical Union.
