The Labour Court rejected a union appeal seeking to remove an unnamed worker’s verbal warning from her personnel file, upholding the Rights Commissioner’s recommendation as fair and reasonable. The decision was dated 13 April 2006. The recommendation said Chorus Ledp should confirm its policy on retaining material in personnel files and allow the worker to inspect her file on reasonable request. The union argued the warning was unfair and that information about the worker’s union representations had been kept on her file. Chorus Ledp said the warning followed an investigation into conduct outside her role.
