Labour Court dismisses National Rehabilitation Hospital worker’s overtime appeal

The Labour Court dismissed a union appeal over a National Rehabilitation Hospital worker’s claim for lost overtime, upholding the Rights Commissioner’s recommendation. The decision was dated 22 February 2006. The union said a fire extinguisher incident injured the worker and that medication prescribed by the hospital worsened the skin irritation, prolonging the absence from work. It sought compensation for lost overtime. The hospital disputed that either alleged cause led to the absence and said the worker received the sick pay due. The Rights Commissioner was not convinced that the absence resulted from either alleged cause. The Labour Court upheld that recommendation and dismissed the appeal.
