The Labour Court dismissed a union appeal over a Wilton Shopping Centre security officer’s claim for lost overtime and upheld the Rights Commissioner’s recommendation. The decision was signed on 16 February 2006. The union said the worker’s domestic arrangements made it difficult for him to return to Thursday or Friday night shifts. The employer said he declined those shifts and later refused Wednesday work when it became available. The union claimed a loss of €65 a week. The Court found the employer had acted reasonably in seeking to provide continued overtime and that the worker had not made sufficient efforts to reduce his loss. It therefore dismissed the appeal. The €65 figure was the claimed weekly loss, not an award.
