The Labour Court dismissed a traffic warden’s appeal over annual leave at Clonmel Borough Council and upheld the Rights Commissioner’s recommendation. The decision was signed on 13 February 2006. The union argued that the Council’s annual leave allocation breached the Organisation of Working Time Act 1997 and sought an audit of the worker’s leave from 1994. The Council said its arrangements complied with the Act. The Court examined leave years 1997 to 2005 and found no breach of the Act. It found the worker had received her full entitlement for each of those years and had no claim for outstanding leave.
