The Labour Court disallowed Mandate’s appeal and affirmed the Rights Commissioner’s recommendation that a Superquinn worker was not eligible to apply for voluntary redundancy. The decision was signed on 22 December 2005. Mandate argued that the worker’s backstore duties made him eligible under the 2001 agreement. Superquinn said he was employed as a sales assistant, did not meet the agreed criteria and was not on the eligibility list. The Court found the Rights Commissioner’s conclusions correct.
