The Labour Court varied a Rights Commissioner’s recommendation on relief work pay and upheld the finding that a worker was not eligible for sick pay. The decision was dated 24 February 2005. The worker, represented by the Services Industrial Professional Technical Union, had been removed from the Tar Plant Operator role after management found him unsuitable for full-time work there. The Court recommended that Roadstone pay him a once-off €200 lump sum plus outstanding payment for relief Tar Plant work. The Court found the worker did not meet the sick-pay scheme conditions and upheld the Rights Commissioner’s recommendation on that claim. The appeal failed overall.
