The Labour Court upheld a recommendation that a worker be supported in returning to work with protective equipment, and the employer’s appeal failed. The Court signed its decision on 7 October 2005. The worker was employed by Sifco Turbine Components. The union sought a return using equipment recommended by the worker’s consultant; the company argued the equipment could be impractical and pose health and safety risks. The Court said all reasonable efforts should be made to assist the return while safeguarding health and safety. It upheld the trial period and reviews recommended by the Rights Commissioner, and said the parties and relevant safety professionals should agree on the practical approach.
