The Labour Court upheld a Rights Commissioner’s recommendation that a worker at Knock Garden Centre was made redundant and the selection was not unfair. The decision was signed on 16 September 2005. The worker, a qualified horticulturist employed as a sales person and nursery manager, claimed wrongful dismissal after receiving one month’s notice in May 2004. The union argued that work remained at the garden centre and he should not have been dismissed. The company said continuing to employ him was economically unviable because the business was not financially successful.
