Labour Court orders fresh Central Bank inquiry after procedural unfairness

The Labour Court found procedural unfairness in a disciplinary investigation by the Central Bank & Financial Services Authority Of Ireland and varied the Rights Commissioner’s recommendation. The decision was signed on 12 August 2005. A worker had been demoted and given a final written warning after allegations that he solicited money from two employees seeking permanent jobs. The Court found that neither he nor his representative could question witnesses, breaching the Code of Practice on Grievance and Disciplinary Procedures. It required a new inquiry by an external investigator, with the Bank paying the costs. The allegations were not decided; the merits were not decided.
