The Labour Court disallowed a worker’s appeal against a Rights Commissioner’s recommendation concerning compensation for an unsuccessful promotion application at Iarnród Eireann. The decision was signed on 15 February 2005. The union claimed approximately £12,000 in earnings losses, excluding expenses, and a further £5,500 linked to a new deal for Gangers. The company said it had conducted promotional competitions fairly and that the worker was later appointed a patrol Ganger in the Cahir division. The Labour Court considered the submissions, found the Rights Commissioner’s conclusions and recommendation reasonable, and affirmed the recommendation, which had not found in favour of the union’s position.
