The Labour Court upheld a Rights Commissioner’s recommendation and dismissed a worker’s appeal against An Post over overtime, pension service and a proposed employee share scheme. The decision was dated 31 May 2005. The recommendation found that the worker’s 1970s service had been counted in his pension, while no formal record supported his claimed 1960s service. It also recommended that his claim for additional overtime fail. The question of any entitlement under the proposed share scheme could not be decided until its terms were agreed. After considering the evidence, the Court found the recommendation fair and just and upheld it.
