The Labour Court dismissed Moffett Engineering Limited’s appeal and upheld a Rights Commissioner’s recommendation to reduce a worker’s final written warning to a written warning. The recommendation was signed on 17 May 2005. The warning followed a verbal altercation between the worker and the company’s health and safety manager during a workplace investigation. The union said the worker apologised and questioned management’s reliance on earlier incidents and a warning it had said was withdrawn. The Court saw no reason to differ from the Rights Commissioner’s conclusions.
