The Labour Court upheld a €200 payment for each of Three Workers after assurances about keeping their hopper jobs during a restructuring at Irish Biscuits Limited’s Tallaght plant. In its decision dated 6 April 2005, the Court rejected their appeal for reinstatement but upheld the compensation recommended by the Rights Commissioner. The workers said management assured them their positions would remain permanent. Irish Biscuits Limited said seniority arrangements governed staffing and accepted that its factory manager had made an honest error in giving the assurances. The Court upheld the company’s right to apply long-standing seniority arrangements and did not concede the claim to return the workers to their former positions. It accepted that assurances had been given and upheld the €200 payment for each worker in full and final settlement of the issue.
