The Labour Court upheld a Rights Commissioner’s recommendation that a general operative at Roscommon County Council receive 90% of the craft rate from 1 January 2004, as a personal-to-holder rate. The decision was signed on 4 October 2004. The Council argued that the worker lacked a recognised craft qualification and was paid the semi-skilled rate for his duties. The Services Industrial Professional Technical Union said he regularly performed craft work and that the Council employed no craftworker in the Boyle area. The Council’s appeal failed.
