The Labour Court upheld a Rights Commissioner’s recommendation that Roscommon County Council appoint a retained firefighter as Sub Officer in the Elphin brigade from 1 September 2002. The decision was signed on 4 October 2004. The Council had appealed after an expected vacancy did not arise because the incumbent did not retire. The Services Industrial Professional Technical Union said the worker had accepted the offer and lost the promised pay increase and status when the appointment did not proceed. The Council’s appeal failed.
