In 2004, the Labour Court found that Northern Feather Limited dismissed a worker without fair procedure and recommended €1,000 compensation. It amended the Rights Commissioner’s recommendation in the worker’s appeal. The decision was signed on 15 July 2004. The union said the worker was dismissed after querying the premium rate for a second-shift transfer and was not represented at probation meetings. The company said he was on probation, had been told to improve his performance and was unsuitable for the job. The Court found the decision to dismiss him had been made before a meeting on 18 November 2003, leaving him no opportunity to speak. It also found the company failed to advise him of his right to shop steward representation.
