The Labour Court upheld a recommendation that Mid West Security Limited pay a worker €1,000 and make efforts to provide additional hours and suitable duties. The Court disallowed the worker’s appeal in a decision dated 23 June 2004. The worker said his hours fell from 48 to 39 a week after he returned from sick leave in July 2002 and that he was not restored to driving duties. Mid West Security said he kept his supervisor’s rate of pay, had no guarantee of a particular position and was not medically fit to resume driving when he returned. The Rights Commissioner had recommended a once-off €1,000 payment, efforts to meet reasonable requests for additional hours and suitable duties similar to his former work when available. The Labour Court found the commissioner’s conclusions consistent with the facts disclosed at the hearing.
