The Labour Court rejected a union appeal and upheld a Rights Commissioner’s recommendation in full in a case involving a Wexford County Council worker. The decision was signed on 21 June 2004. The worker had been made redundant when a Community Employment scheme ended in November 2003. The Services Industrial Professional Technical Union argued that the worker became a direct council employee when appointed scheme supervisor in 1997 and should have been redeployed. Wexford County Council said he remained employed through the FÁS-funded scheme. The Court found the supervisory role remained part of that scheme and rejected the appeal.
