The Labour Court upheld a recommendation that Bord Na Mona pay a bonus to a worker who missed out while on maternity leave and make a related payment to colleagues who covered her work. The decision was signed on 13 February 2004. The Court said there was no basis to withhold the bonus during maternity leave and that a replacement was entitled to the remuneration applicable to the job, including the bonus. It said the calculation should account for the replacement’s time on the team, with the detailed adjustment to be agreed by the company and the Services Industrial Professional Technical Union.
