Labour Court upholds €10,000 payment to Bord Na Mona worker

The Labour Court upheld a €10,000 ex-gratia payment to a Bord Na Mona worker after the company appealed a Rights Commissioner’s recommendation. The decision was signed on 9 February 2004. The union had sought compensation for additional duties the worker said he performed as an Area Bog Foreman. The Court found his Grade 3A grading was proper and retrospective regrading was unjustified, but said there had been a misunderstanding about whether some duties were additional. It left the payment standing in full and final settlement of claims arising from his employment.
