In 2003, the Labour Court rejected a worker’s appeal over a verbal warning issued by Beru Electronics GmbH. The Court upheld the Rights Commissioner’s recommendation in a decision signed on 1 December 2003. The worker, represented by the Services Industrial Professional Technical Union, argued that the warning followed his health and safety complaints. Beru said he had repeatedly been asked to clear his workstation. The Court found that an incident had occurred and management had made its dissatisfaction known, but that the warning was not issued because of the worker’s health and safety complaints. The warning had been removed from his personnel file and could not be used in future discussions.
