The Labour Court reduced a Rights Commissioner’s €3,800 recommendation to €1,800 compensation for a worker dismissed by Matt Kelly T/A The Midway Park Hotel. The Court dated its decision 20 November 2003. The worker, whose name was not published, said he had been unfairly dismissed; management said he left voluntarily. The Court found that the employer had terminated his employment, noting that he was left off the rota after 17 January and that the owner considered his employment ended after an altercation. The Court found that the termination did not follow normal disciplinary procedures or comply with the relevant code of practice. It took the worker’s contribution to the dismissal into account and set compensation at €1,800 in full and final settlement of the claims.
