The Labour Court reduced a Rights Commissioner’s €3,000 recommendation to €1,500 compensation for a worker dismissed by Gardean Hospitality Ltd T/A Sizzlers Restaurant. The Court dated its decision 13 November 2003. The worker, a general worker whose name was not published, said her dismissal was unfair. The company appealed, citing complaints from other staff, a threatening letter to a customer and verbal warnings. The Court found the dismissal procedurally flawed. After a workplace incident, the worker was suspended for a week and then told by telephone that her employment had ended. The Court said the termination did not comply with the Code of Practice on Grievance and Disciplinary Procedures, and varied the recommendation to €1,500 compensation.
