In 2003, the Labour Court upheld a Rights Commissioner’s recommendation that a worker’s seniority claim against Aer Lingus failed, dismissing his appeal. The decision was dated 7 July 2003. The worker, represented by the Services Industrial Professional Technical Union, argued that his permanent service should date from March 1994 rather than March 1996. Aer Lingus said the worker had resigned in 1995 and was re-employed in 1996. The Rights Commissioner found he resigned with effect from 31 October 1995 and that March 1996 was the correct starting date. The Labour Court concurred with those findings and upheld the recommendation. It said the appeal failed.
