In 2003, the Labour Court upheld Scottish Legal Life’s appeal and rejected a Rights Commissioner’s recommendation to include €127 a month of fixed expenses in a worker’s redundancy calculation. The decision was dated 23 June 2003. The worker, who joined the company in 1967, was made redundant with 11 other employees. He said excluding the expenses from his redundancy package cost him about €6,000. The company argued there had been no agreement to include them. The Court said the dispute concerned what the parties had agreed, rather than a legal entitlement, and found no evidence supporting the union’s claim that the expenses should be included.
