The Labour Court found East Coast Area Health Board had treated a worker unfairly in a dispute over an occupational therapy manager job-sharing post. Its decision was dated 12 May 2003. The Court found the worker had accepted the post and that management should have asked her to confirm her decision before appointing another employee to a full-time post. It recommended that the Board offer redress; if the parties could not agree, the Court would make a definitive recommendation on request. The Court rejected the Rights Commissioner's recommendation in favour of the Board and upheld the worker's appeal.
