In 2003, the Labour Court upheld a recommendation that Cainwhite Civils Limited pay a worker €950.71 in arrears for Banksman’s work. The decision was dated 18 March 2003. The Court found that he performed Banksman’s duties and held the required qualification, entitling him to the Technical Operative Rate (Grade A). Cainwhite Civils said the worker was employed and correctly paid as a General Operative. The union said he had told the foreman he held a Banksman’s ticket and had performed those duties. The Court disallowed the company’s appeal and affirmed the Rights Commissioner’s recommendation. A separate claim for payment in lieu of notice was not before the Court on appeal.
