In 2003, the Labour Court rejected Supervalue Killiney’s appeal and upheld a Rights Commissioner’s recommendation that a trainee manager receive €2,000 compensation after being dismissed during probation. The decision was dated 10 March 2003. The Rights Commissioner found that the allegations leading to the dismissal had not been put to the worker appropriately and that he had inadequate time to prepare a defence. Supervalue Killiney said it had issued a formal warning and offered him representation, which he chose not to take. The worker disputed the allegations and said the company had not followed proper procedures. The Labour Court supported the Rights Commissioner’s findings and upheld the recommendation.
