The Labour Court disallowed the Services Industrial Professional Technical Union’s appeal over a worker’s lost shifts with Marken Catering Company, affirming a recommendation that she retain her favoured worker status without compensation for the disputed days. The decision was signed on 7 February 2002. The union said the worker had been denied work on nine occasions and sought 10 days’ lost earnings. The company said she had chosen to work for another caterer on 6 May 2001, when two race meetings clashed. The Court noted that the worker had resumed working for the company and found the Rights Commissioner’s recommendation reasonable and appropriate.
