The Labour Court disallowed a worker’s appeal and affirmed the Rights Commissioner’s recommendation on her placement on the Brothers of Charity’s instructor/supervisor salary scale. The decision was signed on 30 August 2002. The worker returned from a five-year career break in January 2001 and was placed at point 6 on the scale. She argued that she should have been placed higher, saying she had performed the same duties as colleagues who progressed beyond point 5. The Brothers of Charity said normal practice was to start at point 6 when moving to the new scale. The Court found the earlier recommendation was for the worker to move to the instructor/supervisor scale on her return, with placement following normal practice. It concluded that the Brothers of Charity had applied the recommendation correctly and disallowed the appeal.
