Labour Court dismisses worker’s appeal over dismissal

By Gráinne Nolan

Labour Court ·

The Labour Court affirmed a Rights Commissioner’s recommendation in Dawn)’s favour and disallowed a worker’s appeal. The decision was dated 19 July 2002. The worker, a supervisor in the boning hall and packing area, was dismissed after a work injury left him unable to resume his normal duties. The union argued that he lacked representation at meetings and did not receive a letter giving the reasons for his dismissal. The company said medical experts considered him unfit for the available work and that it would consider re-employing him if he received medical clearance. The Court considered the Rights Commissioner’s conclusions and recommendation reasonable in the circumstances, so the recommendation in the company’s favour stood.
