In 2002, the Labour Court upheld a Rights Commissioner’s recommendation that Marlborough Group pay a worker €1,269.74 for unfair dismissal. The decision was signed on 17 June 2002, following the worker’s appeal. The worker had been an accounts manager whose duties included bringing Romanian workers to a Kerry Foods site in Shillelagh, Co Wicklow. Marlborough Group said he was no longer needed by Kerry Foods and no other work was available. The worker believed the company could have offered him alternative work. The company did not attend the hearing. The Court found the Rights Commissioner’s compensation recommendation fair and just in the circumstances and upheld it.
